Our Role
We provide an online marketplace that enables property owners (“Hosts”) and guests (“Renters”) to connect, communicate, and enter into agreements directly with one another. We are not a party to any rental agreement between a Host and a Renter, and we do not own, manage, operate, or control any of the listed properties.
No Liability for Rentals
Because we are not involved in the actual transaction between Hosts and Renters, we make no guarantees about the condition, legality, or suitability of any property. Any rental, use of a property, or interaction between users is made at your own risk. To the maximum extent permitted by law, we disclaim all liability for any injuries, damages, losses, or disputes arising out of or related to a rental.
User Responsibilities
- Hosts are solely responsible for ensuring their property complies with all applicable laws, regulations, safety standards, and insurance requirements.
- Renters are solely responsible for their conduct, their guests, and any damages caused during a stay.
- By using the platform, you agree that any claim or dispute related to a rental must be resolved directly between Host and Renter.
Indemnification
You agree to release, defend, indemnify, and hold harmless POOLPASS LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- your use of the platform or participation in a rental;
- your breach of these Terms or violation of applicable law;
- your interaction with any other user, including any injuries, losses, or damages of any kind arising in connection with such interaction; or
- your listing or rental of a property, including but not limited to any claims for personal injury, property damage, or regulatory violations.
This indemnity obligation survives termination of your account or use of the platform.
